Welcome to Dine Deals ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Dine Deals website, mobile application, and all related services (collectively, the "Platform").
By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Platform.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS OF LIABILITY AND A BINDING ARBITRATION CLAUSE.
"User" or "Diner" refers to any individual who accesses the Platform to discover, view, or redeem restaurant deals.
"Restaurant Partner" refers to any restaurant, food establishment, or business that registers on the Platform to offer deals to Users.
"Deal" refers to any promotional offer, discount, or special pricing made available by Restaurant Partners through the Platform.
"Redemption" refers to the process by which a User claims and uses a Deal at a participating Restaurant Partner location.
"Redeem Code" refers to the unique alphanumeric code assigned to each User for the purpose of verifying deal redemptions.
"Fries" or "Rewards Points" refers to the loyalty points earned by Users through deal redemptions and other qualifying activities.
To use the Platform, you must:
Be at least 18 years of age, or the age of majority in your jurisdiction
Have the legal capacity to enter into a binding agreement
Provide accurate, current, and complete registration information
Maintain and promptly update your account information
Not have been previously suspended or removed from the Platform
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
Upon registration, you will be assigned a unique Redeem Code. This code is personal to you and must not be shared, transferred, or sold. You are solely responsible for all redemptions made using your Redeem Code. Any misuse of your Redeem Code may result in account suspension or termination.
IMPORTANT: The Dine Deals Platform requires access to your device's location services to function properly. By using the Platform, you acknowledge and agree to the following:
You must enable location services on your device to discover nearby deals and Restaurant Partners
Location data is used to verify your proximity to Restaurant Partner locations during deal redemptions
We may use your location data to provide personalized deal recommendations based on your geographic area
Location data may be collected even when the app is running in the background to provide real-time deal notifications
You may disable location services at any time through your device settings, but this may limit or prevent your ability to use certain Platform features

To redeem a Deal, you must present your unique Redeem Code to the Restaurant Partner staff at the time of purchase. The Restaurant Partner will verify your code and apply the applicable discount or offer. Redemptions are subject to availability and the specific terms of each Deal.
Each Deal may have specific terms, conditions, and restrictions set by the Restaurant Partner, including but not limited to:
Validity periods and expiration dates
Minimum purchase requirements
Restrictions on combining with other offers
Limitations on quantity or frequency of redemptions
Dine-in, takeout, or delivery restrictions
We do not guarantee the availability of any Deal. Restaurant Partners may modify, suspend, or discontinue Deals at any time without prior notice. We are not responsible for any Deal that is unavailable, expired, or otherwise not honored by a Restaurant Partner.
Users may earn Fries (rewards points) through qualifying activities, including but not limited to deal redemptions, referrals, and promotional campaigns. The number of Fries earned for each activity will be displayed on the Platform.
Fries may be redeemed for rewards as specified on the Platform. Rewards are subject to availability and may be modified or discontinued at any time. Fries have no cash value and cannot be transferred, sold, or exchanged for cash.
Fries may expire if your account is inactive for an extended period. Upon account termination, all accumulated Fries will be forfeited. We reserve the right to adjust, void, or revoke Fries in cases of fraud, abuse, or violation of these Terms.
Restaurant Partners must complete the registration process and receive approval before listing Deals on the Platform. We reserve the right to approve or reject any Restaurant Partner application at our sole discretion.
Dine Deals operates on a zero-commission model for basic listings. Restaurant Partners are not charged a percentage of sales generated through the Platform. Premium features and enhanced visibility options may be available for an additional fee.
Restaurant Partners are solely responsible for the accuracy of their Deal listings, including pricing, descriptions, terms, and availability. Restaurant Partners must honor all Deals as advertised on the Platform.
You agree not to engage in any of the following prohibited activities:
Creating multiple accounts or using false information
Sharing, selling, or transferring your Redeem Code to others
Attempting to redeem Deals fraudulently or without a valid purchase
Manipulating or exploiting the rewards system
Using automated systems, bots, or scripts to access the Platform
Interfering with or disrupting the Platform or servers
Circumventing security measures or access controls
Harassing, threatening, or abusing other Users or Restaurant Partners
Posting false reviews or misleading content
Violating any applicable laws or regulations
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of Dine Deals or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
The Platform will be uninterrupted, secure, or error-free
The results obtained from using the Platform will be accurate or reliable
Any Deals will be available, accurate, or honored by Restaurant Partners
The quality of any products, services, or information obtained through the Platform will meet your expectations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DINE DEALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Dine Deals and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your conduct in connection with the Platform.
We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease, and any accumulated Fries will be forfeited.
You may terminate your account at any time by contacting us. Termination of your account does not relieve you of any obligations incurred prior to termination.
Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the ADR Institute of Canada.
The arbitration shall take place in Toronto, Ontario, Canada, and shall be conducted in English. The arbitrator's decision shall be final and binding. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada for any legal proceedings arising out of these Terms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and Dine Deals regarding your use of the Platform and supersede all prior agreements and understandings.
